Judge strikes down Obamacare reform!

MIAMI (Reuters) - A federal judge in Florida struck down President Barack Obama's landmark healthcare overhaul as unconstitutional on Monday in the biggest legal challenge yet to federal authority to enact the law.


U.S. District Judge Roger Vinson ruled that the reform law's so-called individual mandate went too far in requiring that Americans start buying health insurance in 2014 or pay a penalty.

"Because the individual mandate is unconstitutional and not severable, the entire act must be declared void," he wrote, "This has been a difficult decision to reach and I am aware that it will have indeterminable implications."


Referring to a key provision in the Patient Protection and Affordable Care Act, Vinson sided with governors and attorneys general from 26 U.S. states, almost all of whom are Republicans, in declaring the Obama healthcare reform unconstitutional.


"Regardless of how laudable its attempts may have been to accomplish these goals in passing the act, Congress must operate within the bounds established by the Constitution," Vinson, who was appointed to the bench by Republican President Ronald Reagan, ruled.

PHOENIX – Governor Jan Brewer today hailed the ruling by Florida U.S. District Judge Roger Vinson as a major victory for states’ rights in its finding that the individual mandate in ObamaCare, which requires everyone to purchase federally-approved health care or pay a penalty beginning in 2014, is an unprecedented and unconstitutional application of the Commerce Clause.

“I knew ObamaCare was unaffordable and unsustainable, and today’s court ruling confirms that it is unconstitutional, as well,” said Governor Jan Brewer. “Our country was founded on the concepts of individual liberty and state sovereignty, not federal mandates and penalties. So I applaud the court for doing its duty in upholding the Constitution, and I look forward to leading the continued fight against this federal monstrosity.”

In a 78-page decision, Judge Vinson ruled for summary judgment in favor of the 26 states regarding the individual mandate provision, striking down every single argument offered by the Obama Administration in its failed effort to justify why Congress should have the power to require its citizens to buy any good or service as a condition of lawful residence in the United States. Moreover, the court held that the individual mandate is not severable from the rest of the act and, therefore, the entire act must be declared void.



As the Governor stated in her letter to Secretary Sebelius last week, Arizona is in a struggle for survival. The Medicaid program is slowly taking over Arizona’s state budget. State obligations for Medicaid have grown from 17 percent of the state General Fund in FY2007 to 29 percent in FY2011. During that time, spending on Medicaid has soared by 63 percent, while the state has slashed spending in almost all other areas of government. This cannot be sustained. Arizona’s deficit is $763 million in FY2011 and a staggering $1.2 billion in FY2012.

In his ruling Judge Vinson said, “Never before has Congress required that everyone buy a product from a private company (essentially for life) just for being alive and residing in the United States.” The Judge went on later to note that if Congress has the power to compel an otherwise passive individual into a commercial transaction with a third party merely by asserting that the transaction is commerce, then “the enumeration of powers in the Constitution would have been in vain for it would be ‘difficult to perceive any limitation on federal power… and we would have a Constitution in name only. Surely this is not what the Founding Fathers could have intended.”


In previous rulings, the Court acknowledged the critical point made by the states in that ObamaCare forces upon them the choice of either accepting the sweeping changes to Medicaid, which will “explode their state budgets,” or withdrawing from the system entirely. ObamaCare transforms Medicaid from a federal-state partnership to reimburse needy persons’ medical costs into a vast federally-mandated program to benefit millions of persons with incomes above the poverty line. The Act now limits state flexibility and turns the states into an administrative arm of the federal government.


Today’s decision striking down ObamaCare in its entirety has a direct impact upon the federal Medicaid requirement from which Governor Brewer sought a waiver last week. If the federal health plan is unconstitutional, she said, it follows that the maintenance-of-effort funding requirement it implemented upon the states would be unconstitutional, as well.


“I hope that federal officials’ take today’s decision into account when reviewing the waiver request that I submitted last week,” said Governor Brewer.





Franks Statement on ObamaCare Once Again Being Ruled Unconstitutional

 
January 31, 2011 — Congressman Trent Franks (AZ-02) today gave the following statement after a federal judge in Florida ruled that the federal government has no constitutional authority to force Americans to purchase private products like health insurance, ruling the entire health care bill unconstitutional as a result of the individual mandate that forms the central pillar to the legislation.
"I know I have been one of this Administration's most stringent critics because of its positions on free enterprise and national security, among many other things. But my gravest concern is that this Administration holds no commitment to the core foundation of our nation, our Constitution. Once again the courts have ruled that Congress does not have the power to tell an individual what he or she must purchase in the private marketplace.

"Indeed, if someone had told the founding fathers that the federal government was Constitutionally permitted to force American citizens to buy a particular product, they would have started a whole new American Revolution.

"Earlier this month, the House of Representatives voted to repeal ObamaCare. It's time -- in the wake of two rulings by federal courts throwing out this overreaching and intrusive legislation -- for this body to act now to defund the legislation, bit by bit-- however necessary-- to prevent great damage from being done not only to our nation's health care system but to the Constitutional framework within which our Republican functions."

The lawsuit in question was brought by 26 states, the National Federation of Independent Business, and two individuals. Last December, Congressman Franks signed an amicus brief in the suit brought by the State of Virginia in which another federal judge found ObamaCare unconstitutional. Congressman Franks is also party to three other lawsuits against ObamaCare, including a suit in Arizona challenging the legislation on the grounds that its prohibition of any future Congress from repealing the law is unconstitutional.

Congressman Franks is serving his fifth term in the U.S. House of Representatives and is a member of the Judiciary Committee, where he serves as Chairman of the Subcommittee on the Constitution and a member of the Subcommittee on Courts, Commercial and Administrative Law. He is also a member of the Armed Services Committee, where he serves on the Strategic Forces Subcommittee and the Subcommittee on Emerging Threats and Capabilities.

SPEAKER KIRK ADAMS CALLS OBAMACARE RULING “MAJOR VICTORY”


STATE CAPITOL, PHOENIX (January 31, 2011) – House Speaker Kirk Adams called today’s ruling on Obamacare by the federal judge a “major victory” for Arizonans and a vindication of Arizona’s decision to join the multi-state suit against the unconstitutional government health care takeover.


Judge Roger Vinson ruled that the entire health care takeover is unconstitutional and said that Congress overstepped its legal bounds when it mandated that Americans purchase health insurance.


“Today is a major victory for the people of Arizona, America and all us of who believe in upholding the United States Constitution. While there were many naysayers here at the Capitol when Arizona joined this lawsuit, clearly we made the right decision. Those critics were just flat wrong.”



“Aside from the unconstitutionality of Obamacare, the law is also set to bankrupt Arizona with its burdensome mandates and costly maintenance of effort requirements, which is why we will continue to seek a waiver from the federal government on these mandates.”


State Sen. Kyrsten Sinema, a major opponent of the lawsuit, told Fox 10 earlier this month that there was no question Obamacare is legal. She said, "It's pretty clear on its face that the health care law is constitutional. In fact, it's in line with over 75 years of similar legislation that has provided health care to Americans such as Medicare, the Veterans' Affairs Office, the Bureau of Indian Affairs.”




"Ultimately, we’ll lose because the federal government clearly has the authority to enact this kind of health reform,” Sinema said.

McCain: This must not turn into Tiananmen Square


Sen. John McCain on Sunday painted a grim picture of the potential consequences of violence in the streets of Egypt.


"We cannot afford another Tiananmen Square in Cairo," the Arizona Republican said on CNN's "State of the Union," noting that the introduction of the army to keep peace in the streets has been a positive development in recent days.

"The bottom line is this: there are some good signs here, its not all terrible," McCain said. "The fact that the army is in control...the army is a respected institution."


But he seemed to give room for the Mubarak government needs to change so that Egypt can transition to a democracy. It's the best of "a lot of bad options," McCain said.


"Not every country can become a democracy at the snap of a finger," McCain said. "Mubarak cannot continue with the oppressive regime they have now."

In the 1950s, the accusation "who lost China" resonated throughout American politics and led to the defeat of the Democratic Party in the presidential elections of 1952. Unless President Obama reverses field and strongly opposes letting the Muslim brotherhood take over Egypt, he will be hit with the modern equivalent of the 1952 question: Who Lost Egypt?


The Iranian government is waiting for Egypt to fall into its lap. The Muslim Brotherhood, dominated by Iranian Islamic fundamentalism, will doubtless emerge as the winner should the government of Egypt fall. The Obama Administration, in failing to throw its weight against an Islamic takeover, is guilty of the same mistake that led President Carter to fail to support the Shah, opening the door for the Ayatollah Khomeini to take over Iran.

The United States has enormous leverage in Egypt - far more than it had in Iran. We provide Egypt with upwards of $2 billion a year in foreign aid under the provisos of the Camp David Accords orchestrated by Carter. The Egyptian military, in particular, receives $1.3 billion of this money. The United States, as the pay master, needs to send a signal to the military that it will be supportive of its efforts to keep Egypt out of the hands of the Islamic fundamentalists. Instead, Obama has put our military aid to Egypt "under review" to pressure Mubarak to mute his response to the demonstrators and has given top priority to "preventing the loss of human life."


President Obama should say that Egypt has always been a friend of the United States. He should point out that it was the first Arab country to make peace with Israel. He should recall that President Sadat, who signed the peace accords, paid for doing so with his life and that President Mubarak has carried on in his footsteps. He should condemn the efforts of the Muslim Brotherhood extremists to take over the country and indicate that America stands by her longtime ally. He should address the need for reform and urge Mubarak to enact needed changes. But his emphasis should be on standing with our ally.

The return of Nobel laureate Dr. Mohamed ElBaradei, the former head of the International Atomic Energy Agency (IAEA) has to Egypt as the presumptive heir to Mubarak tells us where this revolution is headed. Carolyn Glick, a columnist for the Jerusalem Post, explains how dangerous ElBaradei is. "As IAEA head," she writes, "Elbaradei shielded Iran's nuclear weapons program from the Security Council. He [has] continued to lobby against significant UN Security Council sanctions or other actions against Iran...Last week, he dismissed the threat of a nuclear armed Iran [saying] 'there is a lot of hype in this debate'."


As for the Muslim Brotherhood, Glick notes that "it forms the largest and best organized opposition to the Mubarak regime and [is] the progenitor of Hamas and al Qaidi. It seeks Egypt's transformation into an Islamic regime that will stand at the forefront of the global jihad."


Now is the time for Republicans and conservatives to start asking the question: Who is losing Egypt? We need to debunk the starry eyed idealistic yearning for reform and the fantasy that a liberal democracy will come from these demonstrations. It won't. Iranian domination will.

Egypt, with 80 million people, is the largest country in the Middle East or North Africa. Combined with Iran's 75 million (the second largest) they have 155 million people. By contrast the entire rest of the region -- Algeria, Morocco, Libya, Iraq, Saudi Arabia, Yemen, Syria, Tunisia, Jordan, UAE, Lebanon, Kuwait, Oman, and Qatar combined-- have only 200 million.


We must not let the two most populous and powerful nations in the region fall under the sway of Muslim extremism, the one through the weakness of Jimmy Carter and the other through the weakness of Barack Obama.

1. Might Someone Please Educate Fox News and the Rest of the Media?


Fox News has an article on its website about John Boehner’s remarks on raising the debt ceiling. But in this objective report there is a great and dangerous falsehood. The article, which has no author attached to it, reports


“In order for the debt ceiling to rise, Congress must approve taking on more debt, which currently is growing by more than $4 billion per day. If it doesn’t approve raising the ceiling, then the U.S. will default on its loans and lose its standing as the globe’s most reliable bet.”


There is no other way to put this than it is an out and out lie.

2. The “President to doom gun control”


President Obama’s going to be starting a push for “gun control” next month, sayeth insiders - which is a statement that would worry me more if the President hasn’t been a bit of a jinx at using the bully pulpit up to this point. I’m trying - and failing - to come up with something where his “assistance” has been a net positive: all of the Democrats’ dubious legislative successes have been on the Congressional level thus far, and when it comes to skill at advocacy Obama, well… is awful. One wonders what the man hopes to accomplish.


And no, I don’t know what the heck “gun control” has to do with the economy, either.

3. The American Left’s Role in Leading Mid-East Regime Change


As the world watches Egypt crumble into chaos, with over 100 dead and 2000 injured, the Obama administration continues to be somewhat and rather curiously ambivalent. On the one hand, on Friday, Vice President Biden came to the defense of Egyptian President Hosni Mubarak, saying that he shouldn’t step aside. Yet, on the same day, the Telegraph (ala Wikileaks) reported that the U.S. had planned “regime change” for the “past three years” while both President Obama and Secretary of State Clinton demand that internet be restored to the Egyptian protesters. This morning, Secretary of State Clinton again clarified the United States’ official position, ”We do not want to send any message about backing forward or backing back.”


For all the lack of clarity on where the Obama administration stands, one thing is becoming more and more clear: Signs are beginning to point more toward the likelihood that President Obama’s State Department, unions, as well as Left-leaning media corporations are more directly involved in helping to ignite the Mid-East turmoil than they are publicly admitting.

4. President Obama’s Big Diplomatic Test - Egypt


It is clear that the Obama Administration is facing a big diplomatic test in dealing with the fast developing situation in Egypt. On one side is the Obama Administration’s interest of promoting freedom and democracy for the people of Egypt. On the other side is the national security interest of maintaining a strong pro-Western U.S. ally in the Global War on Terror in Egypt. These are very difficult interests to balance.


The big fear in the West is that if this revolution is a success, and the Muslim Brotherhood or another extremist group seizes power in Egypt, the Egyptian people will not secure liberty and freedom. Two co-workers of mine at The Heritage Foundation, James Phillips and James Carafano, have produced excellent analysis that may help conservatives to navigate and understand this difficult issue.

DCCC targets 19 with first media offensive

In the first major media salvo of its effort to reclaim the House in 2012, the Democratic Congressional Campaign Committee is launching an advertising campaign against 19 targeted Republican incumbents.


The radio ads, web ads, phone calls and e-mails are aimed squarely at Republicans in mostly Democratic-leaning districts. The message is that these members want to cut spending at a time when it could lead to further job losses.


"But Congresswoman Ann Marie Buerkle supports a plan in Congress that would cut education by 40 percent," says one radio ad. "And her plan would cut science and technology research by 40 percent, too. Research and development is how we get the new products that create new jobs."


The radio ads will begin running Monday and run through the week during drive time.


The targets are Buerkle and 18 of her colleagues: Reps. Lou Barletta (Pa.), Charlie Bass (N.H.), Steve Chabot (Ohio), Chip Cravaack (Minn.), Bob Dold (Ill.), Sean Duffy (Wis.), Blake Farenhold (Texas), Mike Fitzpatrick (Pa.), Nan Hayworth (N.Y.), Joe Heck (Nev.), Robert Hurt (Va.), Thaddeus McCotter (Mich.), Pat Meehan (Pa.), Dave Reichert (Wash.), David Rivera (Fla.), Jon Runyan (N.J.), Joe Walsh (Ill.), and Allen West (Fla.).


Almost all of these members come from districts that Obama won in 2008, and the DCCC appears to be doubling down on the president's popularity in those districts. The president has seen his approval ratings increase recently, as optimism about the economy returns.


The media blitz is a part of the DCCC's "Drive for 25" -- the slogan it chose for its attempted return to the majority. If Democrats are to win back the majority, they will need to win many of the 19 districts featured in this media campaign.


Dem firms join together: The Washington-based Democratic consulting firm 4C Partners is merging with the New Jersey-based direct mail company Message & Media.


The merger brings to fruition an alliance created during the 2010 election. 4C Managing Partner Brian Smoot was director of the Democratic Senatorial Campaign Committee's independent expenditure operation, and Message & Media is closely tied to then-DSCC Chairman Bob Menendez (D-N.J.).


"By combining our talents and services, 4C/M&M can be a simple solution for hard campaigns," said Smoot, a rising star in the world of campaign operatives. As the DSCC's IE director, Smoot played a key role in keeping the Democratic Senate majority. Prior to that, he was political director at the DCCC when the committee was winning dozens of seats.


Steve DeMicco and Brad Lawrence, the founding partners at M&M, are longtime New Jersey operatives.






Pawlenty says Bachmann would be "a strong candidate": On a trip to Iowa, former Minnesota Gov. Tim Pawlenty offered some praise for a Minnesota colleague and potential presidential campaign opponent, Rep. Michele Bachmann (R).


"Congresswoman Bachmann is someone I have a cordial and positive relationship with," Pawlenty said, referring to his fellow Minnesotan. "I don't know if she's going to run for president. If she does run, she'll be a strong candidate."


Pawlenty has repeatedly praised another outspoken tea party star -- Sarah Palin -- in the same vein. While both women could end up competing with Pawlenty for the Republican nomination, he's also nudging his way into their spotlight.


Playing nice also helps Pawlenty if Bachmann decides not to run, or drops out of the race. Bachmann is a formidable fundraiser and a popular conservative figure. He could pick up an endorsement that gives his campaign some buzz.






Palin's softer line?: In the wake of the Tucson shootings, Palin stood her ground against critics who argued that her language contributed to a culture of violence. "I am not going to sit down, I'm not going to shut up," she told Fox News at one point.


And yet, the Reno Gazette-Journal reported that Palin this weekend had ratcheted back her own rhetoric, telling a hunting and fishing club not her standard "don't retreat, reload," but instead, "don't retreat, stand tall."


It turns out, however, that Palin hasn't retreated at all. One of her aides took to Twitter to adamantly deny that Palin had stopped using the controversial catchphrase.


"Yesterday in Reno Gov. Palin did say her trademark line 'Don't retreat, reload,'" Rebecca Mansour tweeted Sunday evening.


So not only is Palin continuing to use the line; her staffers want to make sure no one thinks otherwise.

U.S. Sen. John McCain speaks at Whiting Field By Travis Griggs



U.S. Sen. John McCain of Arizona visited Whiting Field Naval Air Station on Friday to watch his son receive the Navy's "Wings of Gold."





About 350 people packed into Whiting's auditorium Friday to see 16 helicopter flight training graduates receive their Naval aviator wings.


Among the graduates was Sen. McCain's son, Ensign John S. McCain IV, who began helicopter training at Whiting Field last year.


The winging ceremony is a rite of passage for Navy, Coast Guard and Marine Corps aviators. During the ceremony, graduates' families join them on stage and pin gold wings on the graduates' uniforms.


McCain was the featured speaker at the ceremony, which was casual and upbeat for a formal military function, with frequent jokes and eruptions of laughter.



McCain served for 22 years as a Naval aviator and completed portions of his flight training in Pensacola in the late 1950s and early 1960s.


"In 1960, he sat in a room much like this one ... and received his Wings of Gold," said Lt. Col. Shawn Coakley, commander of Helicopter Training Squadron 18.


During a 15-minute speech, McCain reminisced fondly on his time in Pensacola as a young Naval aviator, "from learning to fly to blowing my pay at Trader Jon's."


"Kick the tires and light the fires," McCain said. "I loved the image of a Naval aviator. I loved the life. It was fun. So much fun, I don't know how I survived it."

McCain had several brushes with death during his time in service, including being shot down over North Vietnam in 1967 and spending 5½ years as a prisoner of war.


McCain said military members today face a more unstable and unpredictable world than the one he served in, but their mission remains the same.


"You are the defenders of our freedom ... and you will protect us from all threats wherever they originate," McCain said.

Ensign McCain graduated from the Naval Academy in 2009 and went through primary flight training at Vance Air Force Base, Okla. He is being transferred to Yigo, Guam, next week to continue training in the Navy fleet.
