TOM HORNE REACTS TO STATEMENT BY AG TERRY GODDARD THAT HE WOULD NOT DEFEND THE IMMIGRATION LAW

PHOENIX –Tom Horne stated:

“If elected Attorney General, I will vigorously defend the law. There is nothing unconstitutional in this statute. Some of the most controversial parts of the statute simply incorporate by reference federal statutes, which have never been attacked as racist, or unconstitutional. The part of the statute permitting police officers to question peopled based on reasonable suspicion is based on a long line of cases that permit brief questioning, based on reasonable suspicion, which “must be based on specific, articulable facts, along with the rational inferences that arise from those facts.” A “hunch” is not sufficient, and racial profiling clearly would not be permissible under court standards. The most common basis for justifying reasonable suspicion is “unprovoked, evasive behavior” attempting to avoid contact with police officers.
