Tom Horne Pledges that As Attorney General He Would Join Lawsuit to Declare the Federal Health Care Bill Unconstitutional

PHOENIX –Tom Horne, Republican candidate for Attorney General announced that, if elected, he would join the lawsuit being brought by a number of other Attorneys General to declare the new federal health care bill unconstitutional.

The current Attorney General, a Democrat, has refused to do so.

Horne also announced his support for Governor Brewer’s and the Legislature’s move to mount a legal challenge against the law despite the current Attorney General’s opposition.


“This health care bill stands to inflict billions of dollars in spending over what Arizona can afford,” Hornesaid.

“The U.S. Constitution has not given the federal government
the power to require people to buy products that they themselves have not chosen to buy, and the Tenth Amendment expressly forbids thefederal government from exercising powers not delegated to it by the Constitution."


The new federal health care bill requires all citizens to buy health insurance, whether they choose to or not, and this isbeyond the powers of the federal government,” Horne added.
