Senator John McCain
, whose Arizona constituents would be among those especially affected if Berkeley law professor Goodwin Liu joins the Ninth Circuit, has written a letter to Judiciary Committee chairman Pat Leahy expressing his concern about the Liu nomination.

One of the concerns that McCain expresses is that Leahy is pushing forward with tomorrow’s hearing so soon after Liu’s massive supplement of his Senate questionnaire response. (See also my “

McCain’s concerns also extend to the substance of the nomination. McCain properly complains of Liu’s “apparently deep activist understanding of judicial power” that would lead him to “stray beyond [the] constitutional role” of a judge.
