Today in a 5 to 4 decision by the Supreme Court, the 2003 Ban on Partial Birth Abortion was upheld. Written by Justice Anthony Kennedy, he said this about the ruling:
"The law is constitutional despite not containing an exception that would allow the procedure if needed to preserve a woman's health, Kennedy said. "The law need not give abortion doctors unfettered choice in the course of their medical practice."
Kennedy's opinion, joined by Bush's two appointees, Chief Justice John Roberts and Justice Samuel Alito, was a long-awaited resounding win that abortion opponents expected from the more conservative bench.
Reacting to the ruling, President Bush said that it affirms the progress his administration has made to defend the "sanctity of life."
"I am pleased that the Supreme Court has upheld a law that prohibits the abhorrent procedure of partial birth abortion," he said. "Today's decision affirms that the Constitution does not stand in the way of the people's representatives enacting laws reflecting the compassion and humanity of America."
Justices Clarence Thomas and Antonin Scalia also were in the majority.
Sen. John McCain released the following statement:
"Today's Supreme Court ruling is a victory for those who cherish the sanctity of life and integrity of the judiciary. The ruling ensures that an unacceptable and unjustifiable practice will not be carried out on our innocent children. It also clearly speaks to the importance of nominating and confirming strict constructionist judges who interpret the law as it is written, and do not usurp the authority of Congress and state legislatures. As we move forward, it is critically important that our party continues to stand on the side of life."

“I am elated that the U.S. Supreme Court upheld the Partial-Birth Abortion Act. We can now breathe a sigh of relief that this gruesome, inhumane, and brutal procedure is now banned in our great nation,” said Pullen. “This is a victory for the American people. It is comforting to know that after a long, hard fight that the ideas of justice, liberty, and righteousness have prevailed.”

It’s evident now more than ever that the entire crop of Democrat presidential candidates are out of step with mainstream America and out of touch with a vast majority of Arizonans that vehemently oppose this terrible practice.”
