Statement by Governor Jan Brewer Ninth Circuit Court Hearing on SB 1070
PHOENIX – "Today the Ninth Circuit Court of Appeal’s heard arguments regarding the State of Arizona’s request to lift the injunction put in place by the federal district court in July regarding enforcement SB 1070.
“My counsel, John Bouma, argued that this case is about what a state – any state – can do about a failed federal immigration system that even President Obama acknowledges is broken. There are very serious crimes associated with this failure, including human smuggling, drug trafficking and other activities involving coyotes in Arizona, as acknowledged by Judge Bolton. Arizona is on the front line in a fight against crime that is spilling over the international border. As noted in the court record, the federal government has essentially had to cede a vast territory inside the State of Arizona to the drug runners and human smugglers.
“With a federal government that cannot or will not do its job, Arizona determined that Arizona law enforcement officers would assist in the enforcement of federal immigration laws to the full extent permitted by federal law. The District Court applied the wrong legal standard of review and issued a preliminary injunction that preserves the status quo – a status quo that is unacceptable to the people lawfully present in Arizona, many whose lives are affected on a daily basis.
Although the judges asked challenging questions of both sides during this morning’s hearing, we are hopeful that after carefully considering the arguments, the Ninth Circuit will lift the stay and allow SB 1070 to be enforced. The health, welfare and safety of the citizens of Arizona are irreparably harmed every day the courts allow SB 1070 to be put on hold and the federal government refuses to enforce all immigration laws.”
PHOENIX – “There have been recent outlandish and completely unsubstantiated reports on liberal internet blogs and Twitter citing anonymous sources questioning my health. Before committing to seek election, I had a complete checkup with my doctors and confirmed there is nothing to prevent me from holding office for four more years.
“I want to assure everyone that my health is fine. I intend to vigorously protect and defend Arizonans for four more years, just as I have over the last two years.”

For someone who Doughery says is ill, the Governor looks pretty healthy to me:
“I am very disappointed that the national government of our neighbors and friends to the south has chosen to file a brief in federal court that distorts the truth about Arizona and the United States.
“Despite false assertions and factual inaccuracies expressed by the country of Mexico in their recent brief filed in U.S. federal court, Arizona’s immigration enforcement laws are both reasonable and constitutional. They mirror what has been federal law in the United States for many decades, and they have built-in and clear protections for civil rights.
“The United States was formed as a nation of laws, and not of men. Arizonans are some of the most hospitable and generous people in the world, and we welcome visitors to share our incomparable natural beauty. Our cultures and our trade are intertwined, and so must be our respect for the rule of law.
“We refuse to accept that the United States government is unable to protect its citizens against a relentless and daily barrage of narco-terrorist drug and human smugglers. We will enforce, respect, and defend the laws of our land, including our laws that prosecute discrimination. We have taken additional steps to update training for our officers to legally enforce our new laws and to specifically prevent illegal racial profiling.
“I will continue to fight tirelessly to protect the citizens of Arizona, and to defend Arizonans in federal court. I believe that Arizona will ultimately prevail and that our laws will be found constitutional.”
“Today the legal team I have appointed to defend the State of Arizona in the legal challenges to Arizona’s new immigration laws met with senior officials from the United States Department of Justice. The meeting was held at the request of the U.S. Department of Justice.
“The Department attorneys were advised that I believe the federal government should use its legal resources to fight illegal immigration, not the State of Arizona. They were further advised that on behalf of the State of Arizona, I will ensure the immigration laws we passed are vigorously defended all the way to the United States Supreme Court if necessary.
“For some inexplicable reason, the Department of Justice officials met with the Arizona Attorney General hours before meeting with the State of Arizona’s legal team, and then allowed the Attorney General to hold a press conference to discuss the meeting. This level of coordination between the Attorney General and the Obama Administration is disturbingly similar to the coordination with Democratic Congresswoman Gabrielle Giffords earlier this week on President Obama’s still unclear plan to deploy up to 1,200 National Guard troops to the border.
“Due to the Attorney General’s opposition to Arizona’s immigration laws as set forth in S.B. 1070, the Legislature required Attorney General Goddard to act at the direction of the Governor in any challenge to S.B. 1070 as amended by H.B. 2162. The Legislature also gave the Governor authority to hire outside counsel if necessary to defend the law on behalf of the State instead of using the Attorney General.
“The Legislature gave me this authority because of its lack of confidence in the Attorney General’s willingness to vigorously defend this legislation that is so critical to protecting the safety and welfare of Arizona’s citizens. Last year, I instructed the Attorney General to change his position on behalf of the State of Arizona in the Horne v. Flores case involving a challenge to the Arizona’s English language learner laws. He refused and the U.S. Supreme Court ultimately rejected his position.
“Due to Attorney General Goddard’s curious coordination with the U.S. Department of Justice today and his consistent opposition to Arizona’s new immigration laws, I will direct my legal team to defend me and the State of Arizona rather than the Attorney General in the lawsuits challenging Arizona’s immigration laws.”
Phoenix – “I want to thank the leadership and members of the Arizona Legislature for their hard work and diligence in promptly addressing one of the most difficult budget challenges in the history of the State of Arizona. They have answered the call, and they have done the people’s business.
“Make no mistake – the seeds of this significant budget crisis have been sown for many years, and thus the solutions are neither easy nor painless. In just over 5 years, spending in the state budget increased from approximately $6 billion to $10 billion. Last year, with most economic indicators suggesting significant economic downturn, a new state budget was built on the false hope of increasing state revenues. More shockingly, new discretionary spending was approved without realistic funding and the state’s rainy day fund was drained. This insatiable appetite for spending has left us with enormous challenges and few options.
“This is not a Republican or Democrat problem, it is a problem that all of us must confront with vigor and regardless of partisan affiliation. Additional fixes are very likely to be required for the fiscal year 2009 budget, and even more difficult decisions remain as we confront the realities of a $3.4 billion deficit for fiscal year 2010.
“We will be back working very hard next week to confront the adversity and to place our great State of Arizona back on the path to prosperity.”
