HORNE APPLAUDS FLORIDA JUDGE'S RULING TO CONTINUE CHALLENGE OF OBAMACARE
PHOENIX – Republican Attorney General nominee Tom Horne says the ruling by a federal judge in Florida that allows states to proceed with a challenge to the Constitutionality of ObamaCare is a victory for taxpayers and he vows to have Arizona join that lawsuit if he is elected Attorney General.
"ObamaCare is a violation of the 10th Amendment, which limits federal powers to those expressly set forth in the Constitution," Horne said. "It must be stopped immediately. That is why I am pleased to see a federal judge in Florida upholding the legal challenge thus allowing states to continue the legal fight against ObamaCare and its unconstitutional mandate that would impose a fine on Americans who opt not to join this scheme."
He added, "If I am elected Attorney General, one of my first acts will be to join this lawsuit and fight it all the way to the U.S. Supreme Court, if necessary. "I have experience battling with the federal government on issues of Constitutional limits," Horne said.
"In the Horne v. Flores English language learner case, I saved the Arizona taxpayers $300 million because we stopped a federal judge from imposing fines and attempting to micromanage legislative policy. It was an important Constitutional victory for 10th Amendment rights because states and their elected legislators - not lifetime appointed judges - have the right to appropriate taxpayer dollars. ObamaCare is similarly a violation of the 10th Amendment because the Constitution cannot be used to compel people to buy something they do not want. I understand those legal distinctions and my opponent does not."
